1. Acceptance of Terms

By accessing or using MemoryCareFind ("the Service") at www.memorycarefind.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. Contact: support@kernelius.com.

2. Description of Service

MemoryCareFind is an online directory of memory care and dementia care facilities in the United States. The Service allows families to search for facilities and submit inquiries, and allows facility owners or managers to claim listings and manage their profiles.

3. Facility Listings

Facility data is sourced from publicly available CMS (Centers for Medicare & Medicaid Services) data. We do not independently verify the accuracy, completeness, or currentness of this data.

We make no guarantees regarding the quality, availability, licensure, or suitability of any facility listed. Families are responsible for independently verifying information before making care decisions. MemoryCareFind is not a referral service and does not endorse any facility.

4. Facility Owner Accounts

Facility owners or managers may claim a listing by creating an account and completing email verification. By claiming a listing, you represent that you are authorized to act on behalf of the facility.

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately at support@kernelius.com if you suspect unauthorized access.

5. Subscriptions and Payments

Plans:

• Basic: $49/month — includes listing claim, contact form, and family lead notifications.
• Premium: $149/month — includes all Basic features plus featured search placement, photo gallery, and priority lead delivery.

Billing:

• Subscriptions are billed monthly via Stripe.
• You authorize us to charge the payment method on file for each billing period.
• You may cancel at any time through the Stripe billing portal in your dashboard. Access does not end immediately upon cancellation — it continues until the end of the current billing period.
• No refunds are issued for partial months or unused service periods.

Price changes:

We reserve the right to change subscription prices with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance.

6. Lead Data

Family inquiries (leads) submitted through the Service are provided to facility owners for the purpose of responding to families. Facility owners may only use lead data to respond to the specific inquiry. Leads may not be sold, shared with third parties, or used for unsolicited marketing.

7. Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent information.
• Claim a listing for a facility you do not represent.
• Use the Service to scrape, harvest, or collect data in bulk.
• Interfere with or disrupt the Service or its servers.
• Use the Service for any unlawful purpose.

We reserve the right to suspend or terminate accounts that violate these terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. USE OF THE SERVICE IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMORYCAREFIND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

10. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or a notice on the site. Continued use of the Service after changes constitutes acceptance.
